The Supreme Court closed out the final day of its term with a slate of major decisions touching on birthright citizenship, election rules, immigration protections and transgender participation in school sports, rulings that quickly sparked debate nationwide.
In one of the most closely watched cases, the court ruled 6-3 to uphold the 14th Amendment’s guarantee of birthright citizenship, allowing people born on U.S. soil to continue to be recognized as American citizens. In a dissenting opinion, Justice Clarence Thomas pointed to the historical context of the amendment, noting that when it was drafted and ratified, the Civil War had just ended and enslaved people had been freed, and that the amendment was created with the citizenship of children of freed slaves in mind.
Trey Trainor, a lawyer and former chairman of the Federal Election Commission, told The National News Desk the court’s decision reflected what he described as the typical understanding of the 14th Amendment. “What the court did was just rule on what the typical understanding of the 14th Amendment has been,” Trainor said.
