Pike’s prognosis remains unclear, and her lawyers said they expect her recovery to be long.
“Against all odds, Christa Pike is conscious, speaking, and continues to receive critical medical care,” attorneys Randy Spivey, Kelly Gleason, Stephen Ferrell and Luke Ihnen said in a statement.
The attorneys said Pike suffered severe injuries to her arms during the Sept. 30 execution attempt and remains handcuffed and shackled to her hospital bed. FOX 17 News has not independently verified Pike’s medical condition, injuries or the attorneys’ description of her restraints.
Pike, 50, was sentenced to death for the 1995 murder of 19-year-old Colleen Slemmer in Knoxville. Tennessee officials administered two doses of pentobarbital during the execution attempt at Riverbend Maximum Security Institution. Pike remained alive and was taken from the prison for medical treatment. She was then placed on a ventilator while she was in critical condition.
Constitutional attorney David Raybin, who helped write Tennessee’s death penalty statute, told FOX 17 News Pike can argue her constitutional rights were violated because of cruel and unusual punishment after the executition attempt.
“(She can) say, you’ve had your chance to execute me, I’ve suffered all of this, I’ve been punished by this. You can no longer execute,” said Raybin.
Pike’s attorneys last Friday in a filed in “Emergency Motion to Preserve Relevant Evidence” in Davidson County Chancery Court, before more legal action is taken. That court hearing takes place Wednesday morning.
This signals future litigation to what Pike’s attorneys describe as a constitutional violation.
Raybin weighed in.
“When a person is sentenced to death, the Eighth Amendment says that the person can be sentenced to dead, and there will be some pain associated with putting a person to death. That is part of the process. But it cannot be extraordinary, it cannot torture, it cannot prolonged. In this case, it was clear that it was prolonged,” said Raybin.
The family of Pike’s victim, Colleen Slemmer, told FOX 17 News what Pike did to Slemmer was torturous.
Pike was convicted in 1996 for the 1995 murder of 19-year-old Slemmer.
Prosecutors say Pike, who was 18 at the time, beat and stabbed Slemmer to death and took a piece of her skull.
However, attorney David Raybin says Pike is still entitled to her constitutional rights under the law and says Pike and her family could have more legal options moving forward.
“Conceptually, she and/or her family could file a civil rights lawsuit against the prison,” Raybin said.
n its statement last Wednesday night, the Tennessee Department of Correction said it followed the state’s established execution protocol, that the lethal injection chemical had “consistently been effective,” and that the protocol did not allow additional procedures beyond those carried out. The department said Pike was transported to an off-site medical facility.
Pike’s attorneys have alleged problems with IV access and the administration of the lethal drug. In Tuesday’s statement, they again said the state had been warned about challenges involving Pike’s veins before the execution attempt. Those allegations have not been independently verified.
The attorneys also renewed their request for Gov. Bill Lee to commute Pike’s sentence to life in prison without parole. The Governor did not answer FOX 17 News as to if he would.
