“But in fraternities, sexual violence has unfortunately been almost enshrined in the history of fraternities. And so it’s really hard to shake that kind of history, especially when we see it continuously repeated. And whether it’s through criminal acts like at Penn State or through sexual violence, which we know, listen, Cornell is getting a lot of attention right now. But we know that this is happening on every college campus, every university campus across the country, whether it’s fraternity involved or not. So I do think it’s an opportunity for campuses to look at their fraternities and sororities.”

”So New York, in their sexual assault code, has a law which does prevent a assailant from sexually assaulting someone if they are physically incapacitated as in if they are incapacitated through intoxication. But only if that intoxication is involuntary. If that intoxication is voluntary as in someone drank on their own or took drugs on their own then the New York law does not consider that person to be incapacitated in that situation. That’s victim blaming straight up in the code but also it prevents a lot of cases from coming forward where prosecutors are reluctant to try to push forward on a case where the person is incapacitated due to voluntary intoxication.”

STORYLINE:
A New York prosecutor has reopened an investigation into gang rape allegations at a Cornell University fraternity in response to a lawsuit filed by a woman who says she was sexually assaulted in 2024 by seven students after being plied with alcohol and drugs.

Tompkins County District Attorney Matthew Van Houten said Monday that his office will present evidence to a grand jury as he faces questions from the public about why there were no criminal prosecutions in the case.
