🇺🇸 New York Assemblyman Jeffrey Dinowitz is pushing to close the state’s “voluntary intoxication loophole” in sexual-assault law.
Currently, “mental incapacity” can apply when someone becomes unable to understand or control what is happening because they were intoxicated without their consent, but not simply because they voluntarily drank or took drugs.
Dinowitz’s bill would change that: whether the intoxication was voluntary would no longer decide the issue if the person was incapacitated and the accused knew or reasonably should have known.
Dinowitz calls the Cornell case involving seven fraternity members, which resulted in no criminal charges, “the straw that broke the camel’s back.”
