Trump’s Midterms Nightmare: Top Court Rejects US President’s Push, Lets California Count All Ballots

The Supreme Court of the United States declined to grant the request made by the Trump Administration, which had sought to compel California to disregard thousands of ballots cast by individuals whom the federal government asserts are non-citizens.

This ruling was issued just a few hours prior to the final day of voting in the highly consequential midterm elections.

Judges declined to step in right away regarding a legal matter concerning 20000 individuals whom the Republican administration had identified as probable noncitizens appearing on the voter registration lists of the state, which is predominantly Democratic.

This prompt dismissal capped a series of setbacks for the US President’s attempt to get involved in the election prior to the tallying of ballots that would determine which party held control of Congress during the final two years of his second term.

Not a single justice issued a public dissent from the decision.

The Court rejected Trump’s emergency request without even asking the other side to respond — Democracy won, California Governor Gavin Newsom, a Democrat, posted on X.

A number of lower courts also turned down the Justice Department’s effort to have the challenged California ballots set aside while the citizenship status of the voters who cast them could be verified.

Moreover, in a legal case that centered on the future certification of Alaska’s election results, a judge dismissed a lawsuit— one that had been ordered by Trump and aimed at blocking a possible Democratic victory in the Senate — without even bothering to hold a hearing first.

The court did not detail its reasoning in the California ballot case, as is common in emergency decisions.

The justices previously rejected Trump’s push to restrict mail ballots around the country in September, even though the justices have sided with his administration in a series of other emergency docket appeals.

In a statement, California Attorney General Rob Bonta, who is a Democrat, drew attention to the Administration’s ongoing pattern of defeats in court.

Courts have now rejected the Trump Administration’s attempts to interfere in California’s elections not once, not twice, not three times, but four times — from the district court to the Ninth Circuit to the U.S. Supreme Court, Bonta said.

He added — This latest decision should put an end to the Administration’s attempt to disrupt California’s elections through emergency court orders.
