It’s one thing to have a lone far-right extremist on the Supreme Court grabbing headlines with inexcusable behavior or disturbing legal arguments. But when the Court is flooded with them, no sooner does one do something egregious than another one steps in to hog the spotlight.

Recently, it came to light that Justice Samuel Alito has been flying inappropriate (to say the least) flags outside his home. First, neighbors took photos of an upside-down American flag, associated with Trump’s “Stop the Steal” movement, flying at Alito’s Virginia home as the Supreme Court was considering an election case in 2021. Then, we found out this wasn’t an isolated incident. An “Appeal to Heaven, was found flying outside Alito’s beach house in New Jersey two years later. This flag is also associated with January 6 insurrectionism and reflects contempt for the rule of law.

Apparently not to be outdone, Justice Clarence Thomas has gotten heads shaking from his recent criticism of Brown v. Board of Education, in which a unanimous Supreme Court ruled that racial segregation in schools in unconstitutional. In a concurring opinion related to a South Carolina congressional map on Thursday, Thomas argued that the Brown decision represented an overreach of judicial power and an “extravagant” use of equitable remedies. Thomas’s comments coincide with the 70th anniversary of the Brown ruling, which was argued by attorney Thurgood Marshall, who later joined the Supreme Court as its first Black justice and would be Thomas’s predecessor.

. . .

If Republicans win in November, we can expect both more alarming antics from Alito and Thomas as well as more justices like them. The United States as we’ve known it could quickly become unrecognizable, drowning in a sea of far-right extremism, fascism, and bigotry. With Supreme Court justices tripping over themselves to legitimize insurrectionists while striving to undo a half-century of progress, it’s time for all voters to reflect on the unprecedented nature of what’s at stake in this upcoming election and commit to vote against the craziness on November 5.
